Limitation of Liability and Indemnification

I fully understand and appreciate both the known and potential dangers of participating in Fuller Soccer Club’s programs and activities. Recognizing the possibility of injury or illness, and in consideration for Fuller Soccer Club (a Minnesota nonprofit corporation) accepting my child as a player in its programs and activities, I consent to my child participating in Fuller Soccer Club and hereby assume all risks, hazards and liabilities that I or my child may suffer resulting or arising from or incidental to my child’s participation in Fuller Soccer Club’s programs and activities involving the contact sport of soccer. I agree that I shall provide health insurance to cover any injury sustained by my child while participating in any Fuller Soccer Club programs or activities or while on the premises of the host facility.

On my own behalf and on behalf of my child, I hereby (i) acknowledge and agree that neither Fuller Soccer Club nor any of its directors, officers, committee members, volunteers, coaches, players and agents, including the owner of fields and facilities utilized by Fuller Soccer Club (collectively, “FSC Parties”) shall be liable for any harm that I or my child may suffer resulting or arising from or incidental to my child’s participation in Fuller Soccer Club’s programs and activities, (ii) release, waive and discharge the FSC Parties from any potential liability and covenant not to sue the FSC Parties in connection therewith, and (iii) indemnify, defend and hold the FSC Parties harmless from and against any and all claims, losses, damages, liabilities, actions, suites, proceedings, costs or expenses that the FSC Parties may incur or sustain or for which they may become liable resulting or arising from or in connection with my or my child’s participation in Fuller Soccer Club’s programs and activities, including without limitation for any losses involving property damage, personal or bodily injury to, or illness or death of, me or my child arising in connection with my or my child’s participation in Fuller Soccer Club’s programs and activities.
